If Boris Johnson loses a no confidence vote but decides to drag Britain out of the EU with No Deal he will be doing so legally, the attorney-general has suggested.


Geoffrey Cox reportedly believes there is no basis to restrict the Prime Minister from taking the country out of the bloc even if the UK is having a general election.


An election could be triggered by a no-confidence vote in the new government when parliament resumes in September, reports the Times.


Usually during an election sitting governments do not make major changes and only 'caretaker decisions', however this is just a convention and not a rule.


An election, which usually lasts seven weeks, could clash with the planned Halloween date to exit the EU and cause a disruption to convention.


Senior figures believe Mr Johnson will be legally entitled to disregard tradition as the default legal position is that Britain leaves the EU on Halloween 


This means that the new Prime Minister, who officially took over from Theresa May earlier this week, could continue with Brexit and leave the EU without a deal.


Cabinet secretary Sir Mark Sedwill has reportedly suggested that the 'status quo' of Britain's EU membership must remain if there is a general election.

However former attorney-general Dominic Grieve told the Times: 'No important policy decisions should be taken which could fetter the freedom of an incoming government.


'No greater fetter could exist than if we irrevocably withdraw from a major treaty.'


Mr Johnson currently has a majority of two, causing concern that he could lose a vote of confidence.  

If this happens he or Labour leader Jeremy Corbyn would have two weeks to try and form a majority leadership.


If they cannot manage this, then the country will face a general election which could last until later than the planned EU exit date of October 31.


On Thursday Jeremy Corbyn refused to launch a vote of no confidence against Boris Johnson after Jo Swinson urged the Labour leader to join forces with her.

Ms Swinson, who became Lib Dem leader earlier this week, wrote to Mr Corbyn to ask him to launch a bid to collapse Mr Johnson's new administration.


But Mr Corbyn dismissed the request and said trying to oust the new PM immediately would only strengthen his position as he accused the Lib Dems of 'childish and irresponsible game playing'.


Ms Swinson hit back and claimed Mr Corbyn was 'aiding and abetting' a Tory-led Brexit.


If Mr Corbyn had agreed to table a vote of no confidence it would likely have taken place on the first day back after the summer break.


Parliamentary convention means it is only the official leader of the Opposition who can ask the Commons Speaker to hold a vote of no confidence in the government.
