A GRIEVING daughter buried her father in the back garden then refused to tell her sister where, a court was told.


Sally Ruhl, 57, got her son to dig a DIY grave for dad Kenneth when he died in July last year, aged 80.

For nine months all she told sister Helen Ruhl, 53, was that he was “in the garden” of the £400,000 home she had shared with him, without saying exactly where in the third-of-an-acre plot.


Helen took her to court in the end and now the macabre row is set to cost Sally a huge sum in legal fees — including paying £35,000 of her sister’s bills.


The High Court heard that Sally organised the DIY burial because she felt unable “to face another funeral” after losing her mum Margaret in April. She said it was intended to be temporary and done with “due dignity”.


She finally agreed to an exhumation and Mr Ruhl was re-buried next to his wife. But Sally refused to let a digger in, insisting her son dig him out again by hand, the London hearing heard.

Afterwards, Helen, who runs a cake business in Cromer, Norfolk, acted to have her sister removed as an executor of their dad’s will.


Her barrister James Poole, describing Sally as “controlling and obstructive”, said the sisters’ relationship was “extremely poor”. But Sally told the court: “Helen knew dad was in the garden. I asked her to come over and I would show her where he was, but I couldn’t force her to come.”


For the exhumation, she asked her son to “dig down to a foot above the coffin rather than getting a digger on site”.


She added: “There was nothing sinister about it. My son had dug the grave in the first place.”

The court heard that the sisters were left equal shares of the house in West Runton, Norfolk, but Sally and her son were living there and its sale was deadlocked.


Judge Paul Teverson ruled that neither sister should be an executor and appointed two lawyers. He ordered Sally to pay more than £35,000 towards Helen’s legal bills.


“There has been misconduct by a person chosen to be an executor and that justifies an order for costs against her,” he said.
