ALFONSO RIBEIRO, who played Carlton in the Fresh Prince of Bel Air, is suing Epic Games over the ‘Fresh’ dance in Fortnite.
The emote bears a striking resemblance to the goofy shuffle Ribeiro performed repeatedly on the show, which ran from 1990 to 1996.
The 47-year-old former Fresh Prince star has filed a suit against Epic Games claiming the company completely ripped off Carlton’s famous dance moves and is effectively profiting from the “intellectual property”.
“It is widely recognised that Mr. Ribeiro’s likeness and intellectual property have been misappropriated by Epic Games in the most popular video game currently in the world, Fortnite,” his lawyer told TMZ.
“Epic has earned record profits off of downloadable content in the game, including emotes like ‘Fresh’. Yet Epic has failed to compensate or even ask permission from Mr Ribeiro for the use of his likeness and iconic intellectual property.”
Ribeiro even performed a version of the dance on Dancing With The Stars — the American answer to Strictly — on his way to claiming the title back in 2014.
Fortnite players can use the in-game currency called V-bucks to purchase emotes, pets, or outfits for their character. These are cosmetic additions are not meant to confer any performance benefit in-game.
While Fortnite is free to play, people spend actual money to get V-bucks and make purchases in the in-game store.
According to the report, Ribeiro claims he is actually in the middle of attempting to copyright the Carlton dance.
He’s also not the first personality to sue the Fortnite creators. An almost identical suit was filed earlier this month by US rapper 2 Milly for the same reason.
“They actually sell that particular move,” the artist told CBS. “It’s for purchase. That’s when I really was like… oh nah, this can’t go on too long.”

Other dances in the game look to be lifted wholesale from elsewhere, with Chance the Rapper, BlocBoy JB and even Scrubs star Donald Faison, who claims he came up with the moves copied for the ‘Dance Moves’ emote.
However, it is currently unclear if dance moves and other similar movements are even copyrightable under current US or international copyright laws.
