New photo Apple sued for ‘hiding ugly notch’ on iPhone XS with ‘misleading’ wallpaper

APPLE is being sued for “misleading” adverts that hide one of the iPhone’s most controversial features.


The notch, which juts out into the top of the screen, is cleverly hidden on some Apple ads – which has been described as a “deception”.

Last year’s iPhone X introduced a new “all screen” design, with almost all of the handset’s front being filled with display.


The only exception is a small area at the top of the panel, which houses the selfie camera and Face ID facial recognition sensors.


The notch proved controversial and was described as “ugly” by some. But the space-age look returned for this year’s iPhone XS.


Now a 55-page lawsuit – first spotted by Business Insider – claims Apple misled customers over the notch, filed on behalf of plaintiffs Christian Sponchiado and Courtney Davis.

The thrust of the argument is that Apple doesn’t provide accurate “pixel counts” for its phones.


Pixels are the tiny dots of light on your phone’s display that make up an image. Generally speaking, more pixels means a higher quality image overall.


Apple lists the iPhone X as having 2436 x 1125 pixels – but the lawsuit says this is a lie.


It says the phone “does not use true pixels with red, green and blue subpixels in each pixel.


“Instead, the product has only false screen pixels, with just two subpixels per false pixel.


“And it does not actually have any subpixels at all in the notch at the top of the screen or in the display-area corners.”


It claims that the larger screen that the new design allows for is a “deception” and “simply based on Apple cutting corners”.


“[Apple’s] website is designed to encourage comparisons between the products and [Apple’s] other phones,” the lawsuit reads.


“These comparisons are misleading because the products have false screen pixel counts that dramatically overrepresent the number of subpixels in the phones.”

To make matters worse, the class-action lawsuit also claims Apple’s ads for the new iPhone XS are dodgy.


This isn’t a new claim: plenty of fans spotted the apparent trickery when Apple announced its latest handsets this September.


In many of its adverts and promo pics, Apple shows the iPhone XS with a planet as the phone’s wallpaper.


But the planet is perfectly positioned so that it doesn’t look like there’s a notch on the screen, as the lawsuit notes.


“[Apple’s] advertising hides the missing pixels,” it reads.


“[Apple] advertises the screens of the iPhone XS and iPhone XS Max products by using a colour image of a planet, so that the black space left by missing pixels will blend in with the black background of the image.


“These images are used on [Apple’s] website to compare the products to other phones.”

The lawsuit claims that one of the plaintiffs, Davis, bought their phone mistakenly, based on these allegedly rogue adverts.


“Images that disguise the missing pixels on the products’ screens are prominent on [Apple’s] website, as well as in the advertisement of retailers who sell the products,” the lawsuit claims.


“These images were relied on by plaintiff Davis, who believed that the iPhone XS and XS Max would not have a notch at the top of the phone.”

The lawsuit was filed in the Northern District of California, and is currently pending class-action status.


It’s possible that the class-action status won’t be granted, of course.

We were impressed with Apple’s latest smartphone, awarding the iPhone XS a 5/5 score in our review back in September.


Our verdict read: “Apple has taken everything that’s good about the iPhone X, and improved on it. It’s not perfect, but it’s the best phone you can buy today.”
