An ex-policeman's daughter caught four times over the drink-drive limit with her 10-year-old niece in the car has moaned her three-year driving ban is too long - because she needs to drive for the school run.
Danielle Grimshaw, 29, from Chadderton, near Oldham, was disqualified from driving until 2021 and fined £200 last October after she was stopped behind the wheel of her Peugeot 207 while drunk on vodka lemonades.
But an appeal judge at Minshull Street Crown Court in Manchester rejected the single mother's plea - and even accused magistrates of being too soft on her.
Grimshaw was pulled over while trying to parallel park near her sister's home after police received a tip-off.
She said the 36 month driving ban imposed by magistrates in Tameside, Greater Manchester, should be less because her daughter, 11, was to start secondary school in September and would now have to use public transport to get there.
Grimshaw added she was the 'main driver' and that the ban would 'impact' her, her daughter and her father who is in a care home.
Judge Mark Savill said: 'This was a very serious offence and in all circumstances the magistrates could have been more severe with their penalty against the appellant.
The mother-of-one said the ban was unfair as it would 'impact' her daughter and her father, who is in a care home
'In all circumstances we feel she was offered considerable leniency in her sentence and therefore we decline to alter the disqualification ban of 36 months. Therefore the appeal is dismissed.'
Grimshaw was caught drink-driving on July 27 last year after she had a few drinks at her sister's house.
Grimshaw was caught nearly four times the legal limit
During the evening, Grimshaw called her daughter's father to pick up the child but then an argument broke out with her sister, who asked her to leave.
At 10.30pm, police received a tip-off and found Grimshaw's vehicle blocking the road. It was unclear why her niece was in the car.
Tests showed Grimshaw had 132 microgrammes of alcohol in 100 millilitres of breath - well above the legal lime of 35 mg.
She was later found guilty of drink driving after a trial and was also fined £200 with £705 in costs and surcharges. She was also ordered to complete a community order for 12 months with rehabilitation activity requirements.
She denied the charge claiming she was not driving the vehicle and had been making phone calls from the driver's seat.
Her lawyer Charlotte Johnson said: 'I accept this was a very high reading and was in the presence of a child. The appellant accepts the aggravated features of the high amount of alcohol in the blood and the feature of the child being present - but she states she travelled a very short distance.
She added: 'She understands the aggravated feature of having a child present. Her most significant mitigation is her personal mitigation. The ban will affect not only her, but her father and her daughter for a considerable period of time. She feels the magistrates did not fully take account of her personal mitigation.'
