A BEAST who got a child pregnant and then let their baby son starve to death with “every bone sticking out” his body has been jailed for just four years.
Darwin Red Cloud, 26, from Rapid City in South Dakota, pleaded guilty to second degree murder and was facing a maximum sentence of life in prison.
The judge admitted that “some may view the sentence as too lenient” when he jailed Red Cloud on Thursday because it was substantially lower than federal guidelines of 17 to 21 years in prison.
The court heard how Red Cloud got the child’s mum pregnant when she was still a minor.
After their baby son, Dalton, was born the infant was allowed to gradually waste away, until his death in 2014 aged just two months.
According to US Attorney Sarah Collins, the photos used as evidence showed “every bone sticking out” of the baby’s body and described Red Cloud’s acts as “wildly neglectful behaviour.”
Red Cloud’s lawyer, Betsey Harris, argued he didn’t understand what it meant to care for a child but now realised he should have asked for help.
She added how the death was the result of a “confluence of circumstances.”
She explained how Red Cloud has learning difficulties that contributed to his son’s death and pointed out how he didn’t grow up with a father figure.
Red Cloud was originally charged with sexual abuse of a minor, a charge that typically requires those convicted to register as a sex offender.
The charge was dismissed in a plea agreement, as well as first degree murder and felony child abuse and neglect, News Center 1 reported.
Addressing the court Red Cloud said: “I’m sorry. I’m not perfect. I’m a human being who has made mistakes.
“I may not be the smartest but I know I can do better. I should’ve paid attention more. I’m sorry.”
Judge Jeffrey Viken said the case was “highly unusual” as most trials involving the death of children involve violence.
He added how it was “hard to comprehend the signs were missed by so many”.
The judge said Red Cloud would get help through his sentence to deal with the disabilities he has faced.
After the hearing, Red Cloud’s sister, Angie Red Cloud, said she didn’t think the baby showed any signs of emaciation.
Writing on Facebook Red Cloud’s cousin Kaitlin Catches, insisted he was “not a monster”.
She said: “I’m so glad the judge seen the good in my cousin and decided to be lenient.
“No matter what the records or his dysfunctional baby momma said, HE IS NOT A MONSTER!
“I’m glad I took the stand to tell these ppl who HE IS! I don’t want my cousin to take the full responsibility but he is because he knows he was a parent.
