"Many Photos" - Blind WW2 hero, 97, in court battle for right to leave his care facility and die at home

A BLIND World War Two hero of 97 returned to court yesterday to fight a council’s refusal to let him die at home.

Former Navy gunner Douglas Meyers, who served in Italy and North Africa, is “unhappy” living in a care facility and desperate to leave.

Social workers claim it is in his “best interests” to stay and a  judge has twice blocked Mr ­Meyers’ request — one a plea to go home for Christmas —  at hearings in London.

Yesterday’s Family Court hearing was held in Southend so Mr Meyers, who lives in nearby Leigh-on-Sea and says he can look after himself, could attend. He  sat in a wheelchair, holding his war medals.

The judge, who lifted an anonymity order on the case, said all evidence and care options had to be weighed up before he would even consider letting Mr Meyers leave the care facility.

Southend-on-Sea Borough Council accepts he has “mental capacity” to make decisions and Judge Mr Justice Hayden, who oversaw earlier hearings, called him “extraordinary”.

But he said granting his wish could put his life in danger.

Lawyers for the council have asked the judge to make a decision about what is in the veteran’s “best interests”.

Meanwhile two lawyers – barrister Parishil Patel QC and solicitor Laura Hobey-Hamsher – are representing the pensioner for free.
