"Many Photos" - US judge faces suspension after he told rape victim she should ‘close her legs’ to prevent attack

A JUDGE is facing suspension after he told a rape victim that she should have “closed her legs” to stop the attack.


Superior Court Judge John Russo, from Ocean County, New Jersey, asked the woman if she did anything to “stop” the rape.

The unnamed victim was seeking a restraining order against her alleged attacker.


He denied the order, saying the evidence was not credible.


The family court judge was later heard mocking the case to staff after the hearing came to an end, it has been reported.


An ethics committee is pushing for him to be suspended for three months after making “infantile and grossly inappropriate” comments.


During the hearing, he asked: “Do you know how to stop somebody from having intercourse with you?

“Close your legs? Call the police? Did you do any of those things?”


Court records show he repeatedly questioned if she really tried to “block” her body parts and leave.


According to the Ashbury Park Press, Russo was caught on the court’s recording equipment poking fun at the case.


He said: “What did you think of that? Did you hear the sex stuff?”


He added: “Oh, my God, that was – was that great?”


MOCKED THE CASE


Russo then said: “What I lack in handwriting skills, I am the master of on the record being able to talk about sex acts with a straight face.”


He told the committee that his question was necessary because it would “demonstrate the element of force or coercion used during the assault”.


The judge denied suggesting a rape victim could stop an attack by closing her legs, Washington Post reported.


His aim was to “aid the plaintiff in recounting a traumatic event” in the 2016 case, he claimed.


Russo’s punishment will be decided by New Jersey’s Supreme Court at a future hearing.

Russo’s attorney, David Corrigan, told NBC New York: “Judge Russo looks forward to a public hearing in which he will be able to respond to the allegations against him.


“We have respect for the process as well as the advisory committee on judicial conduct, and therefore won’t comment further.”
